In June, Florida Gov. Ron DeSantis kicked off a political squabble with Gov. Gavin Newsom after taking credit for sending <a href=\"https:\/\/calmatters.org\/newsletters\/whatmatters\/2023\/06\/migrants-florida-california\/\">36 asylum-seeking migrants to Sacramento<\/a>. The capital city\u2019s under-resourced response <a href=\"https:\/\/calmatters.org\/california-divide\/2023\/10\/texas-to-california-migrant-arrivals\/\">sharply contrasted that of Los Angeles<\/a>, which received more than 900 migrants from Republican states since June.<\/p>\n\n\n\n<p>And earlier this month, the San Diego County Board of Supervisors voted to <a href=\"https:\/\/calmatters.org\/california-divide\/2023\/12\/immigration-california-street-releases\/\">request another $3 million in funding<\/a> for a welcome center that assists migrants. From September through November, U.S. border agents released more than 42,000 migrants onto county streets, as charities struggle to offer services.<\/p>\n\n\n\n<p>Now, the latest disclosures about the immigration system come from <a href=\"https:\/\/calmatters.org\/author\/kervy-robles\/\">Justo Robles<\/a> de CalMatters <a href=\"https:\/\/calmatters.org\/category\/california-divide\/\">Divisi\u00f3n de California<\/a> team, who <a href=\"https:\/\/calmatters.org\/california-divide\/2023\/12\/ice-detention-california\/\">spoke to Jose Ruben Hernandez Gomez<\/a>, a Mexican-born permanent legal resident. He is among the California detainees who in 2022 <a href=\"https:\/\/www.classaction.org\/media\/gomez-et-al-v-the-geo-group-inc.pdf\">present\u00f3 una demanda colectiva<\/a> alleging forced labor against the private prison operator GEO Group and U.S. Immigration and Customs Enforcement, which oversees the detention of immigrants.<\/p>\n\n\n\n<p>Then this week, Hernandez Gomez filed a complaint (a precursor to a potential lawsuit) against Immigration and Customs Enforcement, seeking $1 million in personal injury damages. He alleges that in March during a hunger strike to protest conditions at a Bakersfield detention center operated by GEO Group, he was &#8220;violently dragged&#8221; and sent to another center in Texas, where he says he was shackled and threatened with force-feeding.&nbsp;<\/p>\n\n\n\n<p>From January through October, nearly <a href=\"https:\/\/www.aclunc.org\/CA_database#:~:text=On%20June%2023%2C%202023%2C%20ACLU,our%20state%27s%20immigration%20detention%20facilities.\">400 other grievances have been filed by detainees<\/a> about California detention facilities, half of them about mistreatment and living conditions, according to a tally by the ACLU of Northern California.&nbsp;<\/p>\n\n\n\n<p>In November 2019, Gov. Newsom <a href=\"https:\/\/www.gov.ca.gov\/2019\/10\/11\/governor-newsom-signs-ab-32-to-halt-private-for-profit-prisons-and-immigration-detention-facilities-in-california\/\">signed a bill in an attempt to ban private prisons<\/a> and immigration detention facilities from operating in California. But a federal appeals court struck down the law as unconstitutional, allowing GEO Group facilities in California to continue operating under a $1.5 billion, 15-year federal contract.<\/p>\n\n\n\n<p>Though he returned home to Lodi in April after 16 months in detention, Hernandez Gomez says that he is still \u201cnot free.\u201d He walks with a cane and says he suffers from neurological problems, flashbacks and persistent nightmares, and often cries himself to sleep.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Hernandez Gomez<\/strong>: \u201cI shed tears, because how are they getting away with all this? One document was a frequently overlooked legal affidavit needed to qualify for in-state tuition at California\u2019s public universities and community colleges.<\/p>\n\n\n\n<p>Because of the confusing paperwork, <a href=\"https:\/\/calmatters.org\/newsletters\/whatmatters\/2023\/03\/california-budget-senate-newsom\/#:~:text=From%20CalMatters%20higher%20education%20reporter%20Mikhail%20Zinshteyn%3A%C2%A0\">only about 14%<\/a> of the state\u2019s nearly 100,000 undocumented college students received any state financial aid in 2021-22. But with the passing of a <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billHistoryClient.xhtml?bill_id=202320240AB1540\">nueva ley<\/a>, California\u2019s student aid commission will streamline the process for the California Dream Act Application into one workflow.<\/p>\n\n\n\n<p>Once the application goes live, students pursuing a four-year degree have until April 2 to submit their paperwork, while students applying to community colleges have until early September. And as CalMatters housing reporter <a href=\"https:\/\/calmatters.org\/author\/ben-christopher\/\">Ben Christopher<\/a> explains, the ability for affordable housing developers to <a href=\"https:\/\/calmatters.org\/housing\/2023\/12\/affordable-housing-california-2\/\">grab a slice of a major state funding opportunity<\/a> is proving more competitive than ever.<\/p>\n\n\n\n<p>This is the second year California\u2019s housing department combined the applications of four loan and grant programs. In a single funding blast expected to occur by January, the department will decide among $3.5 billion in requests. But there\u2019s a rub: The state only has $576 million to go around.<\/p>\n\n\n\n<p>This huge funding gap underscores another facet of the California housing debate: Affordable housing is expensive to build, it doesn\u2019t pay for itself and in the face of a $68 billion state budget crunch, money is hard to come by.<\/p>\n\n\n\n<p>Developers who don\u2019t get a cut this round will have to wait until this time next year. Foto de Alisha Jucevic para CalMatters<\/figcaption><\/figure>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p><em>Update: On Dec. 30., another ruling did allow the concealed carry law <a href=\"https:\/\/x.com\/CAgovernor\/status\/1741241243131379911?s=20\">to take effect Jan. 1<\/a>, during the state&#8217;s appeal. <\/em><\/p>\n\n\n\n<p>Here\u2019s one new law that isn\u2019t likely to take effect Jan. 1: California\u2019s ban on carrying concealed guns in a wide range of public places.<\/p>\n\n\n\n<p>On Wednesday, federal Judge Cormac Carney <a href=\"https:\/\/www.latimes.com\/california\/story\/2023-12-20\/federal-judge-blocks-new-california-law-barring-guns-in-many-public-places\">temporarily blocked the law<\/a>, calling it too sweeping, \u201crepugnant to the Second Amendment, and openly defiant of the Supreme Court.\u201d<\/p>\n\n\n\n<p>La Ley <a href=\"https:\/\/calmatters.org\/justice\/2022\/06\/california-concealed-carry\/\">was California\u2019s response<\/a> to a U.S. Supreme Court ruling in June 2022 that dramatically narrowed limits on who can get concealed carry permits.<\/p>\n\n\n\n<p>The California Rifle &amp; Pistol Association sued to stop the law. Chuck Michel, its president, said \u201cpermit holders wouldn\u2019t be able to drive across town without passing through a prohibited area and breaking the law.\u201d<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Michel<\/strong>, in a statement: \u201cCalifornia anti-gun owner politicians refuse to accept the Supreme Court\u2019s mandate from the Bruen case and are trying every creative ploy they can imagine to get around it.\u201d&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Wednesday\u2019s ruling didn\u2019t come from the usual suspect: Federal Judge Roger Benitez, who has <a href=\"https:\/\/calmatters.org\/explainers\/california-gun-laws-policy-explained\/#f798d9c0-979d-11e9-a88d-efa09dd2cf57\">struck down several California gun laws<\/a> y <a href=\"https:\/\/www.gov.ca.gov\/2023\/09\/22\/benitez-duncan\/\">drawn the ire of gun control advocates and politicians<\/a>.&nbsp;<\/p>\n\n\n\n<p>What wasn\u2019t a surprise: The immediate response from Democratic leaders. <a href=\"https:\/\/x.com\/GavinNewsom\/status\/1738207167424122926?s=20\">Gobernador Newsom<\/a>, OMS <a href=\"https:\/\/calmatters.org\/explainers\/new-california-laws\/#98f1f9aa-ec8c-4464-b127-3371a196069e\">signed Senate Bill 2 into law<\/a> in September, said Wednesday\u2019s decision <a href=\"https:\/\/x.com\/CAgovernor\/status\/1737671905342259255?s=20\">defies common sense and endangers Californians<\/a>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Newsom<\/strong>, in his statement: \u201cWhat is repugnant is this ruling, which greenlights the proliferation of guns in our hospitals, libraries, and children\u2019s playgrounds \u2014 spaces which should be safe for all.\u201d&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>One Democrat, however, broke ranks. Sen. <a href=\"https:\/\/calmatters.org\/legislator-tracker\/marie-alvarado-gil-1973\/\">Marie Alvarado-Gil<\/a> of Modesto commended the ruling, saying that the law faced substantial criticism in her district. In a statement, she said \u201cwhile we recognize the importance of public safety, it is imperative that we strike a balance that respects the rights of responsible gun owners.\u201d<\/p>\n\n\n\n<p>While Attorney General Rob Bonta quickly declared that <a href=\"https:\/\/www.oag.ca.gov\/news\/press-releases\/attorney-general-bonta-appeal-decision-blocking-enforcement-sb-2%E2%80%99s-prohibition\">he would appeal the ruling<\/a>, it means another delay in California\u2019s concealed carry rules. A very similar bill was supposed to take effect in September 2022.
