Sometimes, however, a legislator does not vote, either due to an absence or an abstention. But because both are categorized the same way \u2014 as \u201cNo Vote Recorded\u201d \u2014 it\u2019s difficult for constituents to discern <a href=\"https:\/\/calmatters.org\/politics\/2024\/10\/california-legislature-absences-abstentions\/\">if legislators are truly serving their needs<\/a>, escribe el reportero de CalMatters Capitol <a href=\"https:\/\/calmatters.org\/author\/sameea-kamal\/\">Sameea Kamal<\/a>.<\/p>\n\n\n\n<p>This year, seven legislators missed more than a quarter of their opportunities to vote. Cervantes, who missed more votes than any other legislator, had excused absences due to a death in her family and a bout with COVID-19.<\/p>\n\n\n\n<p>But other times the reasons are unclear, so constituents don\u2019t know if their legislators did not vote because they disagreed with the bill but want to remain in good standing with their colleagues; they\u2019re waiting for the bill to be amended; or they\u2019re just out sick.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Lorena Gonz\u00e1lez<\/strong>, California Labor Federation president and former Assemblymember: \u201cAbstain, absent, truly absent, excused absence, unexcused absence, and just sitting at your frickin\u2019 desk and choosing not to vote. \u2026 I don\u2019t think there\u2019s any transparency for constituents.\u201d&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>These no recorded votes, which are counted as \u201cno\u201d votes, can have real consequences: Digital Democracy data shows that 45 bills died in the current two-year legislative session. And in August, during the penultimate week of the session, 21 lawmakers attended the Democratic National Convention. On one of the days, a controversial bill by Sen. <a href=\"https:\/\/calmatters.digitaldemocracy.org\/legislators\/dave-cortese-164699?_gl=1*ql34v9*_gcl_aw*R0NMLjE3Mjg4NDU5MDQuQ2p3S0NBanc5cDI0QmhCX0Vpd0E4SUQ1QmxRV3pVMS1zOHBXM1AwOG5JT2hDOVhlVko1ejB0UWN5UzJCY3FJZW51VkxsT2ZwTm9FckVSb0NNY1VRQXZEX0J3RQ..*_gcl_au*MjEyMTI2NzQ4LjE3MjcxMDg4NTA.*_ga*MTM0NTExODk4NS4xNjkwMzA5NjYy*_ga_5TKXNLE5NK*MTcyOTQ0NjgwMi4xNy4xLjE3Mjk0NDk5ODUuNjAuMC4w*_ga_DX0K9PCWYH*MTcyOTQ0NjgwMi4zNjkuMS4xNzI5NDQ5MDA2LjAuMC4w*_ga_GNY4L81DZE*MTcyOTQ0ODYyOS4xNjE4LjEuMTcyOTQ0OTAwNy4wLjAuMA..\">David Cortese<\/a> related to criminal sentencing was up for consideration. Three of the Republicans also co-sponsored a bill, which never made it out of committee, that essentially proposed to ban abortions nationwide with no exceptions.<\/p>\n\n\n\n<p>But this spring, they walked away from the bill, and several of those in toss-up races say they don\u2019t support a federal ban. In response, Democratic candidates and abortion rights advocates are calling out what they see as Republican backpedaling, hoping that will help them win back the U.S. House majority.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Jennifer Wonnacott<\/strong>, Planned Parenthood Affiliates of California spokesperson: \u201cA lot of these candidates \u2026 really all of them, have tried rewriting their records or reframing it, but their votes, previous comments and statements speak for themselves.\u201d<\/li>\n<\/ul>\n\n\n\n<p>Republicans, however, are accusing Democrats of exaggerating their positions to distract voters from other issues. That\u2019s of 22.7 million ballots sent to registered voters. Gavin Newsom has something of a <a href=\"https:\/\/calmatters.org\/newsletter\/gavin-newsom-friends-foes-elon-musk\/\">love-hate relationship<\/a> with tech billionaire Elon Musk.&nbsp;<\/p>\n\n\n\n<p>In July, the two clashed over a gender identity law that Musk called the final straw in threatening to <a href=\"https:\/\/www.cnn.com\/2024\/07\/16\/business\/elon-musk-spacex-x-texas\/index.html\">move the headquarters of his SpaceX venture<\/a> from California to Texas. They also sparred over a <a href=\"https:\/\/calmatters.org\/explainers\/new-california-laws-2024\/#3650b1e8-5ee9-49e6-8504-a636608a7de4\">law to stop deepfakes in campaign ads<\/a> (which <a href=\"https:\/\/apnews.com\/article\/california-deepfake-election-law-ee5a3d7cba3e9f5caddf91b127e4938a\">a judge temporarily blocked<\/a> this month), with Newsom calling out Musk for sharing <a href=\"https:\/\/www.nbcnews.com\/tech\/misinformation\/kamala-harris-deepfake-shared-musk-sparks-free-speech-debate-rcna164119\">a video in which Vice President Kamala Harris\u2019 voice was doctored<\/a>.<\/p>\n\n\n\n<p>But now, the governor is backing Musk over the state Coastal Commission, which <a href=\"https:\/\/www.latimes.com\/california\/story\/2024-10-16\/spacex-political-bias-coastal-commission-lawsuit\">SpaceX is suing<\/a> after it rejected a Defense Department proposal to increase launches from Vandenberg Space Force Base. Some commissioners cited Musk\u2019s support of former President Donald Trump, which also <a href=\"https:\/\/x.com\/J_GallagherAD3\/status\/1847663947497034131\">angered legislative Republicans<\/a>, who called it an attack on free speech.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Newsom<\/strong>, <a href=\"https:\/\/www.politico.com\/news\/2024\/10\/18\/elon-newsom-musk-california-spacex-00184408\">a pol\u00edtico<\/a>: \u201cI\u2019m with Elon. \u2026 You can\u2019t bring up that explicit level of politics.\u201d<\/li>\n<\/ul>\n\n\n\n<p>In the interview with Politico after stumping for Harris in North Carolina, Newsom also said the commission, which includes his appointees, should decide the permit on its merits: \u201cThese are good commissioners. But you got to call balls and strikes. And trust me, I\u2019m not big on the Elon Musk bandwagon right now.
