Proyecto de ley del Senado 10<\/a>, passed by the Legislature and signed by then-Gov. Jerry Brown in 2018, violated one of the unwritten rules of making public policy in California.<\/p>\n\n\n\n

The measure, one of several criminal justice reforms\nchampioned by Brown during his second governorship, would eliminate cash bail\nfor those accused of crimes in favor of a new \u201crisk assessment\u201d program.<\/p>\n\n\n\n

Criminal justice reformers have clamored for years to eliminate cash bail, saying it discriminates against poor defendants who lack the financial ability to buy their way out of jail while awaiting disposition of their cases. Unable to return to their jobs and families, it\u2019s argued, poor defendants feel compelled to plead guilty rather than await trial.<\/p>\n\n\n\n

While SB 10 drew heavy opposition from bail bond agents, who would be put out of business, its final version was also opposed by civil rights and criminal justice reform groups which disliked the risk assessment alternative that had been inserted at the behest of judges.<\/p>\n\n\n\n

They argued that having judges and probation officers use\ncomputerized risk assessment tools would perpetuate discrimination against poor\ndefendants and could result in more, rather than fewer, being locked up while\nawaiting trial.<\/p>\n\n\n\n

With Brown\u2019s support, the Legislature set aside the\nopposition from both pro- and anti-bail groups but in doing so violated the\nunwritten rule that requires broad support from affected interest groups before\nmaking a major policy change.<\/p>\n\n\n\n

Brown, particularly, should have known that acting without\nsuch support was perilous since one of the major accomplishments of his first\ngovernorship four decades ago was undone by the same unwritten rule.<\/p>\n\n\n\n

He had, after laborious effort, won legislative approval of\na \u201cperipheral canal\u201d to carry water around the Sacramento-San Joaquin Delta,\neven though both environmental groups and San Joaquin Valley\nfarmers opposed it, albeit for vastly different reasons.<\/p>\n\n\n\n

Farmers and environmentalists then forged a strange bedfellows alliance to challenge the peripheral canal via a 1982 referendum<\/a>. By a 2-1 margin, voters rejected the canal and later that year also rejected Brown\u2019s bid for a U.S. Senate seat.<\/p>\n\n\n\n

The dynamics of SB 10 are remarkably similar, with those on\nboth sides of the issues forming an informal alliance to sink the measure. Bail\nbond agents have put up the money to place a referendum on next November\u2019s\nballot while the criminal justice coalition that also opposed the bill has\nlaunched a campaign to denounce the risk assessment program that would replace\nbail.<\/p>\n\n\n\n

JusticeLA Coalition, an umbrella group of criminal justice\nreformers, is opposing plans by the State Judicial Council, an arm of the state\nSupreme Court that represents judges, to proceed with risk assessment pilot\nprograms even though SB 10\u2019s provisions are on hold pending the outcome of the\nreferendum.<\/p>\n\n\n\n

“Replacing money bail with a new system of e-carceration is not progress; it\u2019s the status quo masquerading as reform,\u201d Scott Roberts, a coalition leader, said as the group staged a protest outside the Judicial Council\u2019s offices in San Francisco this month. \u201cWithout community input, SB 10\u2019s early implementation will harm the exact same people who have been targeted by mass incarceration and on a similar scale.\u201d<\/p>\n\n\n\n

Does its criticism of SB 10 mean that Roberts\u2019 coalition\nwill directly support the bail agents\u2019 campaign to erase the law?<\/p>\n\n\n\n

In an interview, Marena Blanchard from Color of Change, one of the coalition\nmembers, hedged a bit. \u201cWe\u2019re not for SB 10,\u201d she said. \u201cWe don\u2019t want to see\nit become law.\u201d However, she stopped short of formally supporting the bail\nagent referendum, saying, \u201cIt\u2019s about more than a referendum.\u201d<\/p>","protected":false},"excerpt":{"rendered":"
