And conservation still lags.<\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\n\t\t\n<p><em>Lea este art\u00edculo en&nbsp;<\/em><a href=\"https:\/\/calmatters.org\/calmatters-en-espanol\/2022\/01\/no-la-sequia-de-california-no-ha-terminado-y-esta-es-la-razon\/\"><em>espa\u00f1ol<\/em><\/a><em>.<\/em><\/p>\n\n\n\n<p>In a clear sign that the drought persists, California today <a href=\"https:\/\/www.waterboards.ca.gov\/water_issues\/programs\/conservation_portal\/docs\/emergency_reg\/drought_emergregtext.pdf\">adopted new emergency regulations<\/a> aimed at stopping residents from wasting the state\u2019s precious water.<\/p>\n\n\n\n<p>The rules <a href=\"https:\/\/www.waterboards.ca.gov\/water_issues\/programs\/conservation_portal\/docs\/emergency_reg\/drought_emergrulemaking_digest.pdf\">ban practices<\/a> such as hosing down sidewalks and driveways with drinking water, washing cars without a shutoff nozzle on the hose and irrigating lawns and gardens too soon after rain.&nbsp;<\/p>\n\n\n\n<p>Approved unanimously by the State Water Resources Control Board, the mandates could take effect as soon as Jan. 15 and have a one-year expiration date unless extended. But with three months left of the wet season, it\u2019s not enough to bring an end to the severe drought and water shortages.<\/p>\n\n\n\n<p>California still needs about another foot of snow water content \u2014 the amount of water contained in the snowpack \u2014 by the end of March to reach its historic seasonal average, according to the state data. Almost 16 inches of snow water content have accumulated <a href=\"https:\/\/cdec.water.ca.gov\/reportapp\/javareports?name=swccond.pdf\">by today<\/a>.<\/p>\n\n\n\n<p>\u201cDecember alone will not end the drought, clearly,\u201d said Jeanine Jones, interstate resources manager for the Department of Water Resources. \u201cDecember was wonderful, but now we just hope it keeps on going.\u201d<\/p>\n\n\n\n<iframe title=\"Springtime snow is key to ending the drought\" aria-label=\"Interactive line chart\" id=\"datawrapper-chart-hed1F\" src=\"https:\/\/datawrapper.dwcdn.net\/hed1F\/11\/\" scrolling=\"no\" style=\"width: 0; min-width: 100% !important; border: none;\" height=\"650\" frameborder=\"0\"><\/iframe><script type=\"text\/javascript\">!function(){\"use strict\";window.addEventListener(\"message\",(function(e){if(void 0!==e.data[\"datawrapper-height\"]){var t=document.querySelectorAll(\"iframe\");for(var a in e.data[\"datawrapper-height\"])for(var r=0;r<t.length;r++){if(t[r].contentWindow===e.source)t[r].style.height=e.data[\"datawrapper-height\"][a]+\"px\"}}}))}();\n<\/script>\n\n\n\n<p>The amount of water now stored is actually worse than last year at this time: The state\u2019s reservoirs in December were projected to contain about 78% of average \u2014 compared to about 82% in 2020.<\/p>\n\n\n\n<p><a href=\"https:\/\/droughtmonitor.unl.edu\/CurrentMap\/StateDroughtMonitor.aspx?CA\">Moderate to exceptional drought<\/a> still grips the entire state, and a soggy start to the rainy season does not guarantee even an average water year. California has felt that false hope before: <a href=\"https:\/\/water.ca.gov\/News\/News-Releases\/2021\/Dec-21\/DWR-12-30-21-Snow-Survey\">In 2013<\/a>, during the last record-breaking drought, a wet December turned into a dry January and February.&nbsp;<\/p>\n\n\n\n<p>Climatologists predict that the state will dry out during the rest of the winter and spring.<\/p>\n\n\n\n<p>\u201cAfter we get through this weather system this week, things go dry. And the expectations are a drier than average January, February and March,\u201d said California\u2019s state climatologist <a href=\"https:\/\/stateclimate.org\/state\/california\/\">Michael Anderson<\/a>.<\/p>\n\n\n\n<p>And conservation still lags. California Gov. Gavin Newsom in July called for Californians to <a href=\"https:\/\/calmatters.org\/environment\/2021\/07\/california-water-use-drought\/\">voluntarily cut water use<\/a> by 15% in the face of the ongoing drought. But state officials today announced statewide savings of only 6% from July to November compared to last year.&nbsp;<\/p>\n\n\n\n<p>November, a dry month, saw only a 6.8% reduction in water use \u2014 down from 13.3% in October, which saw torrential rains. The greatest savings came from the northern half of the state; water use increased slightly by 0.8% in Southern California.<\/p>\n\n\n\n<p>\u201cYou want to kiss every snowflake and every raindrop that comes down, because it was just so bad,\u201d said Felicia Marcus, who chaired the State Water Resources Control Board under Gov. Jerry Brown during the last drought. \u201cAt the same time, we've got to exercise our efficiency muscles every way we can, all the time.\u201d&nbsp;<\/p>\n\n\n\n<iframe title=\"Water stored in California's reservoirs is below average\" aria-label=\"Column Chart\" id=\"datawrapper-chart-dBx2C\" src=\"https:\/\/datawrapper.dwcdn.net\/dBx2C\/4\/\" scrolling=\"no\" style=\"width: 0; min-width: 100% !important; border: none;\" height=\"400\" frameborder=\"0\"><\/iframe><script type=\"text\/javascript\">!function(){\"use strict\";window.addEventListener(\"message\",(function(e){if(void 0!==e.data[\"datawrapper-height\"]){var t=document.querySelectorAll(\"iframe\");for(var a in e.data[\"datawrapper-height\"])for(var r=0;r<t.length;r++){if(t[r].contentWindow===e.source)t[r].style.height=e.data[\"datawrapper-height\"][a]+\"px\"}}}))}();\n<\/script>\n\n\n\n<p>Similar <a href=\"https:\/\/www.waterboards.ca.gov\/board_decisions\/adopted_orders\/resolutions\/2014\/rs2014_0038_regs.pdf\">restrictions on wasteful water use<\/a> were temporarily enacted during the last drought under former Governor Jerry Brown, who also issued <a href=\"https:\/\/www.waterboards.ca.gov\/water_issues\/programs\/conservation_portal\/docs\/factsheet\/implementing_25percent.pdf\">a statewide water conservation mandate<\/a>.&nbsp;<\/p>\n\n\n\n<p>In October, Newsom instructed regulators at the State Water Resources Control Board to <a href=\"https:\/\/www.gov.ca.gov\/2021\/10\/19\/governor-newsom-expands-drought-emergency-statewide-urges-californians-to-redouble-water-conservation-efforts\/\">consider once again barring wasteful water uses<\/a> when he extended the drought emergency statewide.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The emergency rules adopted today take aim at residents as well as homeowners associations, which can no longer penalize residents for brown lawns and drought-tolerant landscaping plants. Local governments may no longer use drinking water to irrigate ornamental turf on street medians.<\/p>\n\n\n\n<p>The new rules do not affect agriculture, the leading user of water in California. And both public commenters and board member Laurel Firestone raised concerns about how penalties could affect low-income Californians \u2014&nbsp;spurring the board to add new language requiring warnings and fees based on the recipient\u2019s ability to pay.&nbsp;<\/p>\n\n\n\n<p>\u201cThis is not the most effective, or even in my mind appropriate policy approach to save water when we're in a drought emergency,\u201d said board member <a href=\"https:\/\/www.waterboards.ca.gov\/about_us\/board_members\/\">Laurel Firestone<\/a>, who called for a more systemic approach rather than individual penalties. \u201cUnfortunately, like in the last drought, we don't have a more appropriate and effective policy developed that we go to in drought emergencies.\u201d<\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div id=\"pym_water-dashboard\"><\/div>\n<script src=\"https:\/\/pym.nprapps.org\/pym.v1.min.js\"><\/script>\n<script type=\"text\/javascript\">\n    var pymParent = new pym.Parent('pym_water-dashboard', 'https:\/\/calmatters-water-dashboard.netlify.app\/recirculate', {});<\/script>\n<\/div><\/div>\n\n\n\n<p>The state's efforts to <a href=\"https:\/\/www.mercurynews.com\/2021\/05\/10\/hosing-down-the-driveway-watering-the-sidewalk-why-california-has-no-statewide-water-wasting-rules-as-it-heads-into-a-new-drought\/\">make permanent<\/a> the emergency water waste rules <a href=\"https:\/\/www.waterboards.ca.gov\/board_info\/agendas\/2018\/feb\/022018_5.pdf\">enacted during the last drought<\/a> faced opposition from powerful urban and agricultural water interests, and ultimately fizzled. <\/p>\n\n\n\n<p>But many local water agencies have already adopted their own rules.&nbsp;<\/p>\n\n\n\n<p>Sacramento, for instance, has prohibited a number of wasteful water uses since 2017, including washing down sidewalks and irrigating so much that it overflows onto sidewalks or streets.&nbsp;<\/p>\n\n\n\n<p>The utilities department \u201ctakes an education-first approach to solving water waste by providing notices to residents before issuing any fines,\u201d Carlos Eliason, a spokesperson for the department, said in an email. Fines, however, can be issued to repeat offenders, and the allowable amount has doubled due to the city\u2019s \u201cWater Alert,\u201d currently ranging from $50 to $1,000.<\/p>\n\n\n\n<p>The East Bay Municipal Utility District also restricts certain wasteful water uses but hasn\u2019t issued any fines over the past year, said spokesperson Tracie Morales.&nbsp;<\/p>\n\n\n\n<p>\u201cMost of our water waste investigations are resolved by reaching out to our customers and providing education and resources, without having to resort to enforcement,\u201d Morales said. However, she said the district can \u201cescalate to a formal warning letter letting them know that we may charge them for additional monitoring, and that we have the right to install a flow restrictor or even shut off their water.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cThere is nothing that obligates us to take specific action and enforce\" the state's new regulations,  Morales said. She added, however, that the district might consider updating its rules to more closely match the state\u2019s wording.<\/p>\n\n\n\n<iframe title=\"Californians used nearly 7% less water in their homes during November 2021 compared to November 2020.\" aria-label=\"Map\" id=\"datawrapper-chart-hmJ2o\" src=\"https:\/\/datawrapper.dwcdn.net\/hmJ2o\/3\/\" scrolling=\"no\" style=\"width: 0; min-width: 100% !important; border: none;\" height=\"711\" frameborder=\"0\"><\/iframe><script type=\"text\/javascript\">!function(){\"use strict\";window.addEventListener(\"message\",(function(e){if(void 0!==e.data[\"datawrapper-height\"]){var t=document.querySelectorAll(\"iframe\");for(var a in e.data[\"datawrapper-height\"])for(var r=0;r<t.length;r++){if(t[r].contentWindow===e.source)t[r].style.height=e.data[\"datawrapper-height\"][a]+\"px\"}}}))}();<\/script>\n\n\n\n<p>Officials couldn\u2019t say how much water the regulations adopted today are expected to save. Instead, they said, the focus is largely on educating consumers, rather than collecting fines.&nbsp;<\/p>\n\n\n\n<p>\u201cI don't believe that there were any fines of up to $500. There were, I believe, a small handful throughout the state of smaller fines after multiple levels of warnings and outreach,\u201d said David Rose, senior staff counsel with the water board. \u201cMostly what the suppliers chose to do was to implement their own existing water waste or water use restrictions as opposed to the board's regulation.\u201d&nbsp;<\/p>\n\n\n\n<p>The timing of the decision after such a soggy start to the water year \u201cwreaks havoc with messaging,\u201d Marcus said.&nbsp;<\/p>\n\n\n\n<p>But it\u2019s a change that she said she hopes will persist longer term \u2014 which would require a different regulatory process.&nbsp;<\/p>\n\n\n\n<p>\u201cTo me, these rules are sort of the least we can do.
