{"id":376752,"date":"2023-12-20T00:01:00","date_gmt":"2023-12-20T08:01:00","guid":{"rendered":"https:\/\/calmatters.org\/?p=376752"},"modified":"2023-12-19T15:56:25","modified_gmt":"2023-12-19T23:56:25","slug":"workplace-decrees-negative-consequences","status":"publish","type":"post","link":"https:\/\/calmatters.org\/_es\/commentary\/2023\/12\/workplace-decrees-negative-consequences\/","title":{"rendered":"El impulso de California por leyes laborales puede tener consecuencias negativas para los trabajadores"},"content":{"rendered":"<p>When federal government and state governments passed laws governing wages, working hours and other workplace conditions prior to World War II, agricultural labor was exempted.<\/p>\n\n\n\n<p>Many years later, after the 40-hour work week became standard, California\u2019s Industrial Welfare Commission decreed that farmworkers could work up to 10 hours a day or six days a week before overtime pay kicked in.<\/p>\n\n\n\n<p>In 2016, however, years of lobbying by unions and other groups finally paid off when the Legislature decreed that the eight-hour day and 40-hour work week for agricultural labor would be phased in. Then-Gov. Jerry Brown signed the legislation, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201520160AB1066\" target=\"_blank\" rel=\"noreferrer noopener\">Assembly Bill 1066,<\/a> despite warnings from farm groups that it would disrupt their industry.<\/p>\n\n\n\n<p>Recently, the University of California\u2019s Cooperative Extension branch, which researches agricultural issues, <a href=\"https:\/\/s.giannini.ucop.edu\/uploads\/pub\/2023\/11\/06\/v27n1_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">public\u00f3 un estudio<\/a> indicating that having a 40-hour work week has not been as beneficial to farmworkers as its sponsors promised.<\/p>\n\n\n\n<p>Alexandra Hill, an assistant professor at UC Berkeley, concluded that many workers who had hoped for a cornucopia of overtime pay saw their incomes reduced when employers limited them to 40 hours a week. Her study found that many workers experienced reductions in the $100-$200 range each week because farmers could not automatically pass on overtime costs to their customers.<\/p>\n\n\n\n<p>\u201cIt\u2019s really important to think carefully about how we can best implement policies that really benefit the people that we\u2019re trying to (help),\u201d <a href=\"https:\/\/www.sacbee.com\/news\/equity-lab\/accountability\/article283101308.html\" target=\"_blank\" rel=\"noreferrer noopener\">Hill told The Sacramento Bee<\/a>.<\/p>\n\n\n\n<p>Hill\u2019s research exemplifies the phenomenon of unanticipated consequences that often afflicts political actions. Legislators may have thought they could help farmworkers by giving them a 40-hour workweek but failed to consider the potential downsides when applied in the real world.<\/p>\n\n\n\n<p>In recent years, the Legislature has been particularly prone to passing laws affecting workplace conditions \u2013 not surprisingly, given the close relationship between the Capitol\u2019s dominant Democrats and labor unions, which seek benefits they are unable to achieve in unionization drives or negotiations with employers.<\/p>\n\n\n\n<p>The most spectacular example was <a href=\"https:\/\/en.wikipedia.org\/wiki\/California_Assembly_Bill_5_(2019)\" target=\"_blank\" rel=\"noreferrer noopener\">2019 legislation<\/a> that severely limited employers\u2019 ability to use contractors, in effect <a href=\"https:\/\/calmatters.org\/economy\/2023\/03\/prop-22-appeal\/\">converting several million workers to payroll employees<\/a>.<\/p>\n\n\n\n<p>Hill&#8217;s study was released just months after the Legislature had set new minimum wages for the <a href=\"https:\/\/calmatters.org\/california-divide\/2023\/09\/minimum-wage-california\/\">Comida r\u00e1pida<\/a> y <a href=\"https:\/\/calmatters.org\/health\/2023\/10\/california-minimum-wage-health-care-law\/\">medical care<\/a> industries, $20 per hour for the former and $25 for the latter, to dampen threats of ballot-box wars. <\/p>\n\n\n\n<p>As with the 2016 law on farm labor, unions and other advocates of the new minimum wages said they would lift workers in the affected industries out of poverty.<\/p>\n\n\n\n<p>\u201cToday California is putting a stop to the hemorrhaging of our care workforce by ensuring health care workers can do the work they love&nbsp;and&nbsp;pay their bills \u2013 a huge win for workers&nbsp;and&nbsp;patients seeking care,\u201d Tia Orr, executive director of SEIU California, told CalMatters.<\/p>\n\n\n\n<p>However, there will be real world impacts.<\/p>\n\n\n\n<p>Fast food franchisees will adjust by hiring fewer workers, raising prices or adopting more technology, such as the self-serve kiosks now common at McDonald\u2019s.<\/p>\n\n\n\n<p>One effect of the health care wage bill has already surfaced. When it was passed, legislators were not given any estimates of the financial impact, but after Gov. Gavin Newsom signed the measure, his administration said it would cost the state budget, which has a <a href=\"https:\/\/www.latimes.com\/california\/story\/2023-11-04\/healthcare-minimum-wage-expected-to-cost-4-billion-in-first-year-as-california-budget-deficit-looms\" target=\"_blank\" rel=\"noreferrer noopener\">$68 billion projected deficit<\/a>, <a href=\"https:\/\/www.latimes.com\/california\/story\/2023-11-04\/healthcare-minimum-wage-expected-to-cost-4-billion-in-first-year-as-california-budget-deficit-looms\">about $4 billion a year<\/a> split 50-50 between state and federal taxpayers. And that doesn\u2019t include the multibillion-dollar impact on private health care providers and insurers.<\/p>\n\n\n\n<p>On one level, it\u2019s perfectly understandable why politicians would like to raise wages for some of the state lowest paid workers.
