But it is by many definitions still a petro-state: the <a href=\"https:\/\/www.eia.gov\/state\/?sid=CA\">nation\u2019s seventh largest<\/a> oil producer, California ranks third in its oil refining capacity and meets <a href=\"https:\/\/www.energy.ca.gov\/data-reports\/energy-almanac\/california-electricity-data\/2020-total-system-electric-generation\/2019\">over 40%<\/a> of its energy needs using natural gas.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Oil wells and gas lines leak and spill, and the effects to the communities that surround them are far broader and longer-lasting than most people realize. The Gulf Coast\u2019s <a href=\"https:\/\/www.science.org\/doi\/full\/10.1126\/science.aab4133\">2010 Deepwater Horizon<\/a> oil spill, for instance, devastated two industries critical to communities \u2013 tourism and fishing \u2013 which in turn was associated with a rise in <a href=\"https:\/\/www.rand.org\/pubs\/research_reports\/RRA409-1.html\">mental health problems<\/a> along the region. Such problems can persist for years and years after spills, long after cleanup efforts have ceased.<\/p>\n\n\n\n<p>But in many ways events like Deepwater Horizon or, in California, <a href=\"https:\/\/www.cpuc.ca.gov\/regulatory-services\/safety\/pipeline-safety\/aliso-canyon-well-failure\">2015\u2019s Aliso Canyon<\/a> gas leak and the <a href=\"https:\/\/www.npr.org\/2021\/10\/14\/1046164240\/california-oil-spill-25-000-gallons\">Orange County oil spill<\/a> last year, are relatively easy to address. They capture the attention of the media, the public and <a href=\"https:\/\/www.latimes.com\/california\/story\/2022-02-09\/huntington-beach-oil-spill-inspires-legislation-to-ban-california-offshore-drilling\">regulatory agencies.<\/a> Chronic so-called <a href=\"https:\/\/www.jstor.org\/stable\/pdf\/10.1525\/sp.2002.49.2.150.pdf\">\u201csilent spills&#8221;<\/a> can go <a href=\"https:\/\/search.informit.org\/doi\/abs\/10.3316\/ielapa.200804015\">unnoticed for decades<\/a>, and their impacts are felt most by underserved populations.&nbsp;<\/p>\n\n\n\n<p>For instance, a recent study <a href=\"https:\/\/journals.lww.com\/environepidem\/Fulltext\/2020\/08000\/Oil_and_gas_production_and_spontaneous_preterm.1.aspx?context=LatestArticles\">found a connection<\/a> between exposure to oil and gas well sites and spontaneous pre-term births, largely among Hispanic and Black women. <a href=\"https:\/\/ehp.niehs.nih.gov\/doi\/full\/10.1289\/EHP5842\">Another study<\/a> looking at birth records from 2006 to 2015 in rural California associated proximity to oil and gas wells with low-birthweight babies and other adverse birth outcomes.<\/p>\n\n\n\n<p>And yet, despite all the risks, the communities that are most affected by drilling, refining and transport remain largely cut out of the <a href=\"https:\/\/law.stanford.edu\/2021\/10\/05\/stanfords-deborah-sivas-on-the-california-oil-spill-and-challenges-of-regulating-off-shore-drilling\/\">complex system of state and federal decision making<\/a> that oversees oil and gas permitting. Existing oil and gas leases are largely top-driven, and <a href=\"https:\/\/www.nrdc.org\/experts\/josh-axelrod\/doi-seeks-basic-reform-not-overhaul-oil-gas-program\">insulated from affected communities<\/a> in ways that <a href=\"https:\/\/www.doi.gov\/sites\/doi.gov\/files\/report-on-the-federal-oil-and-gas-leasing-program-doi-eo-14008.pdf\">the federal government argues<\/a> are in need of reform.<\/p>\n\n\n\n<p>Such reforms could begin with a re-visiting of historic, 100-year-old <a href=\"https:\/\/thehill.com\/opinion\/energy-environment\/592671-bidens-climate-promises-require-oil-and-gas-leasing-reform\">oil and gas lease structures<\/a> to ensure community involvement \u2013 from the planning stages, to the drilling itself, to long after the well is decommissioned (so-called \u2018idle wells\u2019 can release toxic emissions).&nbsp;<\/p>\n\n\n\n<p>There is already a good model for involving communities for local air quality monitoring. In 2018, the state formed the Community Air Protection Program, or&nbsp; <a href=\"https:\/\/ww2.arb.ca.gov\/capp\/about\">CAPP<\/a>. Although still an experiment-in-progress, the program can be a blueprint for how community-driven process can be used to monitor local pollution and develop mitigation plans.&nbsp;<\/p>\n\n\n\n<p>The Community Air Protection Program uses existing local networks such as the <a href=\"https:\/\/woeip.org\/featured-work\/owning-our-air\/\">West Oakland Environmental Indicators Projec<\/a>t and South L.A.\u2019s <a href=\"https:\/\/www.ccair.org\/clear\/community-air-protection-project\/\">Coalition for Clean Air<\/a>, to serve as a bridge between government <a href=\"https:\/\/www.epa.gov\/caa-permitting\/clean-air-act-permitting-california#:~:text=Clean%20Air%20Act%20permitting%20in%20California%20is%20the%20shared%20responsibility,pre%2Dconstruction%20or%20operating%20permits.\">air pollution agencies<\/a> such as the 35 regional air monitoring districts and the California Air Resources Board, to identify local pollution hotspots and tailor community mitigation strategies. For instance, the Coalition for Clean Air installs <a href=\"https:\/\/www.prgs.edu\/news\/2019\/cazier-air-quality-analysis.html\">low-cost air quality sensors<\/a> at community volunteers residences to identify particulate matter <a href=\"https:\/\/www.ccair.org\/clear\/air-quality-monitoring-network\/\">emissions spikes<\/a>, such as from gas flaring at ExxonMobil\u2019s nearby oil refinery.<\/p>\n\n\n\n<p>The statutory authority that oversees oil and gas operations in the state, the <a href=\"https:\/\/www.slc.ca.gov\/laws-regulations\/current-regulations\/\">California State Lands Commission<\/a>, could learn from the Community Air Protection Program. It could <a href=\"https:\/\/www.slc.ca.gov\/laws-regulations\/new-proposed-regulations\/\">enact regulations<\/a> to give communities living near oil and gas wells training and tools to help local agencies <a href=\"https:\/\/www.rand.org\/blog\/2019\/03\/lessening-leakages-how-water-systems-can-learn-from.html\">identify leaks<\/a> and spills \u2013 &nbsp; crowd-sourcing leak detection before it becomes a larger-scale problem.&nbsp;<\/p>\n\n\n\n<p>Re-shaping the current top-down structure for regulating oil operations to include a community-led process for monitoring, identification and development of mitigation solutions can not only empower local communities, but also help agencies and companies stave off costly and deadly disasters.
