{"id":311244,"date":"2023-08-23T00:01:00","date_gmt":"2023-08-23T07:01:00","guid":{"rendered":"https:\/\/calmatters.org\/?p=311244"},"modified":"2023-08-22T16:36:22","modified_gmt":"2023-08-22T23:36:22","slug":"education-lawsuit-muzzle-researchers-testify","status":"publish","type":"post","link":"https:\/\/calmatters.org\/_ko\/commentary\/2023\/08\/education-lawsuit-muzzle-researchers-testify\/","title":{"rendered":"California walks back decision to muzzle researchers testifying in pandemic education lawsuit"},"content":{"rendered":"<p>As noted in this space recently, there\u2019s been a <a href=\"https:\/\/calmatters.org\/commentary\/2023\/08\/california-legislature-encourage-government-secrecy\/\" target=\"_blank\" rel=\"noreferrer noopener\">recent trend in California\u2019s state government toward secrecy<\/a> \u2013 restricting the flow of information to media and the public about what officialdom is doing.<\/p>\n\n\n\n<p>A prime example of that trend was a harsh warning from the Department of Education to education researchers that they could be punished if they testified in any lawsuit against the department.<\/p>\n\n\n\n<p>A clause in research contracts banned such testimony, even if the researcher was not using data obtained from the department. The warning, which <a href=\"https:\/\/edsource.org\/2023\/california-backs-down-on-punishing-education-researchers-who-testify-against-it\/696031\" target=\"_blank\" rel=\"noreferrer noopener\">officials partly walked back<\/a>, was issued because the state was being <a href=\"https:\/\/www.sfchronicle.com\/california\/article\/lawsuit-asks-california-schools-hurt-low-income-18204720.php\" target=\"_blank\" rel=\"noreferrer noopener\">sued by students<\/a> whose schooling was interrupted and damaged by shutdowns during the COVID-19 pandemic.<\/p>\n\n\n\n<p>Attorneys for the plaintiffs sought expert testimony from academic researchers about the effects of the shutdown and the evidently haphazard efforts to instruct students online, known colloquially as \u201czoom school.\u201d<\/p>\n\n\n\n<p>Several studies have demonstrated that not only did <a href=\"https:\/\/calmatters.org\/commentary\/2023\/07\/pandemic-poor-achievement-california-schools\/\">academic achievement among California\u2019s nearly 6 million public school students suffered<\/a> mightily, but that the already yawning achievement gap between poorer and English-learner students and their more privileged contemporaries became even wider.<\/p>\n\n\n\n<p>For example, the <a href=\"https:\/\/www.ppic.org\/wp-content\/uploads\/student-achievement-on-californias-k-12-assessments.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Public Policy Institute of California found<\/a> that, before the pandemic, 51% of students met standards in English language arts, or ELA, and it had dropped to 47%. In mathematics, proficiency declined from 40% to 33%.<\/p>\n\n\n\n<p>\u201cOnly 35% of low-income students met state standards in ELA and 21% were proficient in math,\u201d PPIC reported, \u201ccompared to 65% of higher-income students in ELA and 51% in math.\u201d<\/p>\n\n\n\n<p>California tended to keep its schools closed longer than those in other states, largely due to reluctance of powerful teacher unions to reopen. So the loss of learning found by PPIC and others is \u2013 or should be \u2013 embarrassing to officialdom, from Gov. Gavin Newsom down. That\u2019s why, one suspects, the Department of Education initially wanted to shut down researchers who would testify about negative impacts.<\/p>\n\n\n\n<p>When the efforts to muzzle researchers became known, thanks to dogged reporting by EdSource, there was widespread condemnation from the media and free speech advocates. Last week, the criticism, and the possibility of an adverse judicial ruling, <a href=\"https:\/\/edsource.org\/2023\/california-backs-down-on-punishing-education-researchers-who-testify-against-it\/696031\">paid off<\/a> \u2013 more or less.
