Some want to use campaign cash for protection"},"content":{"rendered":"<div class=\"wp-block-group has-light-gray-background-color has-background calmatters-summary\">\n\t\t\t<div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n\t\t\t\t\n\t\t\t\t<p class=\"has-small-font-size calmatters-summary-heading\"><strong>\uc694\uc57d\ud574\uc11c<\/strong><\/p>\n\t\t\t\t\n\n\t\t\t\t\n\t\t\t\t<p class=\"calmatters-summary-content\">With continuing concerns about political violence, a bill would allow candidates and elected officials to use campaign donations for security expenses. Gov. Newsom vetoed a similar bill last year. \n<\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\n\t\t\n<p><em>\uc774 \uc5ed\uc0ac\ub97c \uc77d\uc5b4\ubcf4\uc138\uc694 <a href=\"https:\/\/calmatters.org\/calmatters-en-espanol\/2024\/05\/violencia-politica-california-seguridad-legisladores-campana\/\" target=\"_blank\" rel=\"noreferrer noopener\">\uc2a4\ud398\uc778\uc5b4<\/a><\/em><\/p>\n\n\n\n<p>Last spring, Assemblymember <a href=\"https:\/\/calmatters.digitaldemocracy.org\/legislators\/isaac-bryan-165440\">\uc544\uc774\uc791 \ube0c\ub77c\uc774\uc5b8<\/a> received a letter calling for him to be lynched because of a bill he introduced to change <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB421\">how ballot measures are presented to California voters<\/a>.<\/p>\n\n\n\n<p>It\u2019s not the only time he\u2019s been subjected to threats or harassment. Bryan said he and fellow Assemblymember <a href=\"https:\/\/calmatters.digitaldemocracy.org\/legislators\/mia-bonta-165422\">\ubbf8\uc544 \ubcf8\ud0c0<\/a> received hundreds of threats when <a href=\"https:\/\/calmatters.org\/justice\/2023\/07\/child-trafficking-bill-california-legislature\/\">they didn\u2019t vote in a committee on a bill<\/a> increasing penalties for child trafficking, until it added language that he said would protect victims.&nbsp;<\/p>\n\n\n\n<p>\u201cThe one that I&#8217;ll probably forever remember is a suggestion that my fianc\u00e9 and mother should be human trafficked so that I understand how serious this is \u2014 which, for a legislator who travels four days out the week and leaves my loved ones at home, you know \u2014 that was not taken lightly,\u201d Bryan told CalMatters.&nbsp;<\/p>\n\n\n\n<p>Currently, to use campaign funds, lawmakers have to file a police report. But threats happen \u201call the time,\u201d Bryan said, and legislators just need \u201cbasic security\u2026protection that you need to do this job.\u201d<\/p>\n\n\n\n<p>That\u2019s why the Culver City Democrat supported a bill last year by <a href=\"https:\/\/calmatters.digitaldemocracy.org\/legislators\/mia-bonta-165422\">\ubcf8\ud0c0<\/a> that would have made it easier for local and state candidates and elected officials to use campaign funds for security.&nbsp;<\/p>\n\n\n\n<p>The Legislature passed the bill, but Gov. Gavin Newsom vetoed it, saying it lacked clear definitions of security expenses. \u201cThis bill could have unintended consequences and could lead to use of political donations for expenditures far beyond what any reasonable donor would expect,\u201d he wrote <a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2023\/10\/AB-37-VETO.pdf\">in his veto message<\/a> last October. \u201cWe must ensure political donations are utilized in a manner consistent with their intended purpose.&#8221;&nbsp;<\/p>\n\n\n\n<p>But for Bonta, the issue remains worth addressing. She revised and reintroduced the bill, which passed the Assembly on a 72-0 vote last week and is before the Senate.<strong> <\/strong>Because <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202320240ab2041?slug=CA_202320240AB2041\">Assembly Bill 2041<\/a> would amend the voter-approved 1974 Political Reform Act, it requires a two-thirds vote in both the Senate and Assembly to pass. If Newsom signs this version, it would take effect immediately, making it available to those currently campaigning for the November election.&nbsp;<\/p>\n\n\n\n<p>Under current law, elected officials or candidates can get reimbursed for the costs of a home or office security system if they have received threats to their physical safety that are verified by law enforcement. But they can\u2019t be reimbursed for more than $5,000 for their entire career \u2014 which the bill\u2019s supporters say <a href=\"https:\/\/calmatters.digitaldemocracy.org\/hearings\/257582?t=1553&amp;f=c9611f76a9ce556a7564d1c4091698a3\">hasn\u2019t been adjusted<\/a> to reflect the current costs for home alarm systems or other security measures.&nbsp;<\/p>\n\n\n\n<p>The new bill would eliminate the lifetime dollar limit, and allow money to be spent on protection for family members, if the threats are related to duties of a candidate or elected official.&nbsp;<\/p>\n\n\n\n<p>Bonta, an Oakland Democrat, told CalMatters the feedback received from the governor\u2019s office on last year\u2019s bill was late in the legislative process. The new bill was amended to clarify what can be considered a security expense and tightened up disclosure requirements to ensure transparency. Specifically, it does not allow the funds to be used for firearms, and would require the politician to maintain detailed records.<\/p>\n\n\n\n<p>The bill also removes language requiring verification of threats by law enforcement, instead allowing expenses on \u201creasonable costs.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>The city of Beverly Hills, while acknowledging that more needs to be done to protect elected officials, opposed last year\u2019s bill unless there was a financial cap. The city expressed concern that the protection for immediate family members and staff could be abused \u201cwithout better safeguards in place,\u201d including a narrower definition on whom the campaign funds can be expended on for security.<\/p>\n\n\n\n<p>Concerns for how campaign funds are used aren\u2019t unfounded. Former U.S. Rep. Duncan Hunter <a href=\"https:\/\/www.sandiegouniontribune.com\/news\/watchdog\/sd-me-hunter-rabbits-20170103-story.html\">pled guilty in 2019<\/a> to misusing funds on resort stays, jewelry, video games and, perhaps most notoriously, $600 in airline fees for a pet rabbit. And last November, former Orange County Assemblymember Bill Brough was fined $100,000 for using campaign funds on family vacations, as well as on supplies he took home when he left office: a $1,300 custom cigar humidor, a custom bourbon cabinet and a portable ice maker, according to a <a href=\"https:\/\/www.fppc.ca.gov\/content\/dam\/fppc\/NS-Documents\/AgendaDocuments\/General%20Items\/2023\/november\/4-Bill-Brough-Default%20Exhibits%201%20A%20A-1%20through%20A-26%20and%20B%20through%20D_Redacted.pdf\">Fair Political Practices Commission<\/a> \ubcf4\uace0\uc11c.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-threats-target-lawmakers-unevenly\">Threats target lawmakers unevenly <\/h3>\n\n\n\n<p>Being able to use campaign funds could help fill gaps in the security provided by the Legislature.&nbsp;<\/p>\n\n\n\n<p>For events, lawmakers must request security in advance and explain why it\u2019s needed, and can request ongoing security from the state. Photo by Miguel Gutierrez Jr., CalMatters<\/figcaption><\/figure>\n\n\n\n<p>The state, however, would not release data on the number of threat assessments based on reports by lawmakers, citing an exemption to the Legislative Open Records Act that allows the state to withhold records of complaints or investigations that it conducts, or security procedures.&nbsp;<\/p>\n\n\n\n<p>Still, there have been some high-profile examples of attacks on elected officials and their families, including <a href=\"https:\/\/calmatters.org\/newsletters\/whatmatters\/2022\/10\/paul-pelosi-attack\/\">the 2022 attack on Paul Pelosi<\/a>, husband of former House Speaker Nancy Pelosi in their San Francisco home. Sen. <a href=\"https:\/\/calmatters.digitaldemocracy.org\/legislators\/scott-wiener-100936\">\uc2a4\ucf67 \uc704\ub108<\/a>, a Democrat from San Francisco, has spoken out about numerous incidents, including emailed <a href=\"https:\/\/www.nbcbayarea.com\/news\/local\/san-francisco\/death-threats-emailed-to-sen-scott-wiener-staff-during-pride-event\/2918439\/\">death threats he received in 2022<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Bonta said local candidates and fellow legislators had shared their own personal experiences or those of their staff that she felt prompted the need for the bill \u2014 as well as an experience of her own.&nbsp;<\/p>\n\n\n\n<p>\u201cI&#8217;ve had an instance of being on my front lawn, and having somebody text me from an unknown number to say that I looked really good on my lawn,\u201d she said. \u201cThose are all things that make us, just, not feel very safe.\u201d&nbsp;<\/p>\n\n\n <div class=\"cm-leg-card cm-leg-card-padding\">\n     <p class=\"cm-leg-card-h6\">\uc774 \uae30\uc0ac\uc5d0 \uc5b8\uae09\ub41c \uc785\ubc95\uc790\ub4e4\uc5d0 \ub300\ud574 \uc790\uc138\ud788 \uc54c\uc544\ubcf4\uc138\uc694.<\/p>\n     <div class=\"cm-leg-list\">\n     \n        <a href='https:\/\/calmatters.digitaldemocracy.org\/legislators\/caroline-menjivar-165436' class='cm-leg-card-padding'>\n            <p class='cm-leg-card-h6'> \uce90\ub864\ub77c\uc778 \uba58\uc9c0\ubc14\ub974<\/p>\n            <p> Democrat, State Senate, District 20 (Van Nuys)<\/p>\n        <\/a>\n    \n        <a href='https:\/\/calmatters.digitaldemocracy.org\/legislators\/mia-bonta-165422' class='cm-leg-card-padding'>\n            <p class='cm-leg-card-h6'> \ubbf8\uc544 \ubcf8\ud0c0<\/p>\n            <p> Democrat, State Assembly, District 18 (Oakland)<\/p>\n        <\/a>\n    \n        <a href='https:\/\/calmatters.digitaldemocracy.org\/legislators\/isaac-bryan-165440' class='cm-leg-card-padding'>\n            <p class='cm-leg-card-h6'> \uc544\uc774\uc791 \ube0c\ub77c\uc774\uc5b8<\/p>\n            <p> Democrat, State Assembly, District 55 (Culver City)<\/p>\n        <\/a>\n         <\/div>\n\n<\/div>\n\n\n\n<p>A report by the University of San Diego&#8217;s Violence, Inequality, and Power Lab and the Institute for Civil Civic Engagement found that of the 328 local elected officials surveyed, 75% reported being threatened or harassed and 35% said it happened monthly.&nbsp;<\/p>\n\n\n\n<p>The survey also found that women were more impacted than men: 82% of female local elected officials, compared with 66% of men.&nbsp;<\/p>\n\n\n\n<p>That\u2019s largely in line with national trends reported by the Brennan Center for Justice, which <a href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/intimidation-state-and-local-officeholders\">released a report in January<\/a> that documented a \u201cbarrage of intimidating abuse\u201d against state and local elected officeholders.&nbsp;<\/p>\n\n\n\n<p>\u201cThreats and attacks constrain how freely of\ufb01ceholders interact with constituents, narrow the spectrum of policy positions they feel safe to support, and make them less willing to continue in public service,\u201d said the report, based on surveys of 1,744 local officeholders and 354 state legislators. \u201cUnaddressed, the problem stands to endanger not just individual politicians but, more broadly, the free and fair functioning of representative democracy \u2014 at every level of government.\u201d&nbsp;<\/p>\n\n\n\n<p>It\u2019s harmful for <a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/political-intimidation-threatens-diversity-state-and-local-office\">gains in diversity, too<\/a>, the researchers note. Women were three to four times as likely as men to experience abuse targeting their gender, while elected officials of color were more than three times as likely as white of\ufb01ce holders to experience abuse targeting their race.&nbsp;<\/p>\n\n\n\n<p>That\u2019s for those who are already in office. Threats, harassment and intimidation are also <a href=\"https:\/\/calmatters.org\/politics\/2022\/09\/california-2022-election-women-legislature\/\">rampant on the campaign trail<\/a>.&nbsp;<\/p>\n\n\n\n<p>A 2023 study conducted by the California Women&#8217;s list found that 42% of women encountered stalking at least once while running, with almost one in five experiencing it frequently or very frequently \u2014 15 times higher than what\u2019s reported by men. The rate was higher among women of color \u2014 55% \u2014 and LGBTQ+ women, at nearly 53%.<\/p>\n\n\n\n<p>\uc13c. <a href=\"https:\/\/calmatters.digitaldemocracy.org\/legislators\/caroline-menjivar-165436\">\uce90\ub864\ub77c\uc778 \uba58\uc9c0\ubc14\ub974<\/a>, a Democrat from Van Nuys, introduced a bill to <a href=\"https:\/\/drive.google.com\/file\/d\/1DtKYVh_6R6eV211aCguyDLmT6aFe5R94\/view\">allow candidates to use campaign funds for mental health services<\/a>.
