Gavin Newsom<\/a> and Attorney General Rob Bonta \u2014 that <a href=\"https:\/\/calmatters.org\/newsletters\/whatmatters\/2021\/12\/texas-abortion-ban-newsom-assault-weapons\/\">co-opts the structure of Texas\u2019 abortion ban<\/a>&nbsp;by giving private citizens the right to sue manufacturers, sellers and distributors of illegal assault weapons, &#8220;ghost&#8221; guns and certain other firearms and to collect at least $10,000 in civil damages per weapon. <\/p>\n\n\n\n<p>State Sen. Bob Hertzberg, the Van Nuys Democrat who authored the bill, noted &#8220;it may not be the perfect solution&#8221; \u2014 among other things, it would be invalidated if the U.S. Supreme Court were to strike down the Texas law \u2014 but said California should &#8220;use every tool available to try and reduce this extraordinary and horrible epidemic of gun violence.&#8221; <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The bill progressed the same day that Sacramento police <a href=\"https:\/\/apnews.com\/article\/business-california-sacramento-crime-gun-politics-1d199428230e554f8f93ce01d0451945\">arrested Smiley Martin<\/a> \u2014 one of three suspects taken into custody in connection with the mass shooting \u2014 on charges including possession of a stolen handgun <a href=\"https:\/\/apps.sacpd.org\/Releases\/liveview.aspx?reference=20220405-031\">converted into a fully automatic weapon<\/a>. Martin, his brother Dandrae Martin, and Daviyonne Dawson <a href=\"https:\/\/apps.sacpd.org\/Releases\/liveview.aspx?reference=20220405-032\">were all charged<\/a> with possessing a firearm <a href=\"https:\/\/calmatters.org\/series\/outgunned\/\">despite being prohibited from having one<\/a>. Dawson <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article260143115.html\">was released Tuesday<\/a> after posting $500,000 bail. <\/li><li>Also Tuesday, <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article260131840.html\">a stunning Sacramento Bee report<\/a> found that Smiley Martin in February won early release from a 10-year prison sentence for domestic violence and assault with great bodily injury. The ruling from <a href=\"https:\/\/www.cdcr.ca.gov\/bph\/\">the Board of Parole Hearings<\/a> \u2014 part of the Newsom administration \u2014 came despite strong opposition from Sacramento County District Attorney Anne Marie Schubert&#8217;s office, which warned the board that &#8220;if he is released early, he will continue to break the law.&#8221;<\/li><li>That will likely add fuel to what&#8217;s expected to be an already intense attorney general race: Schubert, a Republican-turned-independent, is one of Bonta&#8217;s main challengers for the role of California&#8217;s top cop. She&#8217;s also one of 44 district attorneys <a href=\"https:\/\/www.sacda.org\/2022\/03\/public-comment-period-on-cdcrs-attempt-at-permanent-early-prison-release-regulations\/\">suing the Newsom administration<\/a> over proposed rule changes that she says could result in the early release of thousands of violent offenders.<\/li><li><strong>Assembly Republican Leader James Gallagher of Yuba City: <\/strong>Smiley Martin &#8220;was a violent felon with a long rap sheet who should have been in prison. If he was, this tragedy might have been avoided. If this violence a few blocks from the Capitol doesn\u2019t serve as a wake-up call to the policymakers in this building, I don\u2019t know what will.&#8221; <\/li><\/ul>\n\n\n\n\n\n<p>Meanwhile, two other high-profile crime-related bills failed Tuesday to pass key committees.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Before it could receive a hearing, Democratic Assemblymember Al Muratsuchi of Torrance pulled his bill to toughen aspects of Proposition 47 \u2014&nbsp;<a href=\"https:\/\/www.courts.ca.gov\/prop47.htm\">a 2014 ballot measure<\/a>&nbsp;that reduced penalties for certain theft and drug offenses \u2014 and establish diversion and job training programs for some offenders. In a statement, Muratsuchi told me &#8220;the Assembly Public Safety Committee proposed to gut the bill to make it meaningless.&#8221; <\/li><li>And GOP state Sen. Photo by Gabrielle Lurie, San Francisco Chronicle via AP<\/figcaption><\/figure>\n\n\n\n<p>How did the Oakland Police Department become a progressive model for law enforcement agencies across California \u2014 one that sustains complaints against its officers at a higher rate than any other major law enforcement entity apart from the state Department of Corrections and Rehabilitation?<\/p>\n\n\n\n<p>\u4f5c\u4e3a <a href=\"https:\/\/calmatters.org\/justice\/2022\/04\/oakland-police-citizen-oversight\/\">CalMatters&#8217; Nigel Duara reports in this beautifully written piece<\/a>, the story goes back to the late 1990s, when the police departments in Oakland and Los Angeles were rocked by unrelated but similar scandals. Although the&nbsp;<a href=\"https:\/\/lao.ca.gov\/Publications\/Series\/1?utm_source=laowww&amp;utm_medium=email&amp;utm_campaign=S1\" target=\"_blank\" rel=\"noreferrer noopener\">six analyses<\/a> didn&#8217;t make legislative recommendations, nor did they pull any punches in <a href=\"https:\/\/calmatters.org\/environment\/2022\/04\/california-climate-change-report-legislature\/\">laying out a future<\/a> plagued by increasing wildfires, rising seas, extreme heat, poor air quality and increasingly at-risk vulnerable populations.
