{"id":291218,"date":"2023-02-27T05:00:00","date_gmt":"2023-02-27T13:00:00","guid":{"rendered":"https:\/\/calmatters.org\/?p=291218"},"modified":"2023-02-26T18:44:26","modified_gmt":"2023-02-27T02:44:26","slug":"california-cannabis-emerald-triangle","status":"publish","type":"post","link":"https:\/\/calmatters.org\/_zh\/newsletters\/whatmatters\/2023\/02\/california-cannabis-emerald-triangle\/","title":{"rendered":"Despair in Emerald Triangle as CA legal cannabis collapses"},"content":{"rendered":"<p>In 2016, when California voters faced the choice of whether to legalize marijuana for recreational use, they heard promises that it would help end a racist \u201cwar on drugs,\u201d bring a violent illegal market out of the shadows and, by the way, bring in tax revenue. <a href=\"https:\/\/calmatters.org\/politics\/2022\/01\/california-cannabis-newsom\/\">\u52a0\u6587\u00b7\u7ebd\u68ee<\/a>, then lieutenant governor and now governor, said so.&nbsp;<\/p>\n\n\n\n<p>More than six years later, while <a href=\"https:\/\/www.courts.ca.gov\/prop64.htm\">Proposition 64<\/a> has <a href=\"https:\/\/www.library.ca.gov\/wp-content\/uploads\/crb-reports\/2021_05_Cannabis_Policy_Brief.pdf\">cut arrests for marijuana-related offenses<\/a>, it hasn\u2019t lived up to its billing for the small cannabis growers in Northern California\u2019s famed Emerald Triangle.&nbsp;<\/p>\n\n\n\n<p>CalMatters politics reporter <a href=\"https:\/\/calmatters.org\/author\/alexei-koseff\/\">\u963f\u5217\u514b\u8c22\u00b7\u79d1\u585e\u592b<\/a> spent several days this month in Humboldt and Trinity counties. What he heard from growers, workers, business owners, local officials and others was that plummeting prices are causing the collapse of the legal cannabis market \u2014 and the economies of surrounding communities with it.&nbsp;<\/p>\n\n\n\n<p>Commercial cannabis sales <a href=\"https:\/\/www.sfgate.com\/cannabis\/article\/california-legal-pot-sales-drop-17800119.php?IPID=SFGate-HP-CP-Spotlight\">fell by 8%<\/a> last year to $5.3 billion, according to just-released <a href=\"https:\/\/www.cdtfa.ca.gov\/dataportal\/dataset.htm?url=CannabisTaxRevenues\">state tax data<\/a> \u2014 the first decline since it became legal in 2018. And <a href=\"https:\/\/www.cdtfa.ca.gov\/news\/23-02.htm\">state tax revenue dropped<\/a> from $251.3 million in the third quarter of 2022 to $221.6 million in the fourth quarter.<\/p>\n\n\n\n<p>Cultivators who can barely make ends meet are laying off employees, slashing expenses or shutting down their farms. For many, the situation is verging on despair \u2014 seen in the faces of people whose images were captured by CalMatters assistant photo editor <a href=\"https:\/\/ona22.journalists.org\/speaker\/martin-do-nascimento\/\">Martin do Nascimento<\/a>. Photo by Robbie Short for CalMatters<\/figcaption><\/figure>\n\n\n\n<p><strong><em>From CalMatters higher education reporter <\/em><\/strong><a href=\"https:\/\/calmatters.org\/author\/mikhailzinshteyn\/\"><strong><em>\u7c73\u54c8\u4f0a\u5c14\u00b7\u6d25\u65bd\u5766<\/em><\/strong><\/a><strong><em>:<\/em><\/strong><\/p>\n\n\n\n<p>Is noise from student parties a type of pollution?&nbsp;<\/p>\n\n\n\n<p>Yes, a <a href=\"https:\/\/appellatecases.courtinfo.ca.gov\/search\/case\/mainCaseScreen.cfm?dist=1&amp;doc_id=2385633&amp;doc_no=A165451&amp;request_token=OCIwLSEmLkw9W1BdSCFNWEtIUEw6UVxfJSNOVz9TLDtKCg%3D%3D\">state appellate court ruled on Friday<\/a>, delaying a <a href=\"https:\/\/twitter.com\/mzinshteyn\/status\/1629311328837074945\">much-needed UC Berkeley housing project<\/a> that would provide affordable dorm rooms to nearly 1,200 students and homes for another 125 formerly homeless adults in the community.&nbsp;<\/p>\n\n\n\n<p>The court ruled that the campus and UC system submitted an inadequate Environmental Impact Report and failed to consider whether another location for the project was more suitable.&nbsp;<\/p>\n\n\n\n<p>But it&#8217;s the second, novel reason that has the university, housing advocates and some powerful state political leaders crying foul: The court also ruled that the university &#8220;failed to assess potential noise impacts from loud student parties in residential neighborhoods near the campus, a longstanding problem that the EIR improperly dismissed as speculative.&#8221;<\/p>\n\n\n\n<p>UC lawyers argued that the ruling, which revolves around the California Environmental Quality Act, may open the door for other neighborhood groups to stall not just campus housing but any housing development. UC said it\u2019s appealing to the California Supreme Court.<\/p>\n\n\n\n<p>The appeals court maintained that the environmental report is a form of transparency that must explain to the public all the major issues and complications of a development.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The court:<\/strong> &#8220;Ultimately, CEQA allows an agency to approve a project, even if the project will cause significant environmental harm, if the agency discloses the harm and makes required findings.&#8221;<\/li>\n<\/ul>\n\n\n\n<p>But several key lawmakers are <a href=\"https:\/\/twitter.com\/BuffyWicks\/status\/1629925453824937985?s=20\">vowing to push back<\/a> against what they call an abuse of the landmark environmental law. Assemblymember <a href=\"https:\/\/calmatters.org\/legislator-tracker\/josh-hoover-1988\/\">\u4e54\u4ec0\u00b7\u80e1\u4f5b<\/a>, a Republican from Folsom, had already introduced <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB1700\">Assembly Bill 1700<\/a> to change CEQA so that noise caused by future residents isn&#8217;t an environmental factor in the eyes of the law.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Gov. Gavin Newsom, <\/strong><a href=\"https:\/\/twitter.com\/CAgovernor\/status\/1629602373319688192?s=19\"><strong>in a tweet Saturday<\/strong><\/a><strong>:<\/strong> &#8220;Our CEQA process is clearly broken when a few Berkeley homeowners can block desperately needed student housing for years and even decades \u2026 The law needs to change, and I am committed to working with lawmakers this year to making more changes so our state can build the housing we desperately need.&#8221;<\/li>\n<\/ul>\n\n\n\n<p>Does all this sound familiar? Last year, state courts blocked UC Berkeley\u2019s plans to enroll all the students it sought <a href=\"https:\/\/calmatters.org\/education\/higher-education\/2022\/03\/uc-enrollment-cap-fix\/\">until a last-minute legislative fix<\/a>.&nbsp;<\/p>\n\n\n        <div class=\"cm-whatmatters-divider-plus\"><div class=\"cm-whatmatters-divider-plus__divider\"><\/div><\/div>\n        \n\n\n<p><strong>In other California higher education news:<\/strong>&nbsp;<\/p>\n\n\n\n<p>Remote proctoring software gained popularity during the pandemic as a way for universities to ensure that students sitting for exams miles from campus weren\u2019t cheating. But, in light of privacy concerns, a federal judge ruled last fall that requiring students\u2019 rooms to be scanned by a computer camera, as some e-proctoring companies do, was unconstitutional.&nbsp;<\/p>\n\n\n\n<p>So <a href=\"https:\/\/calmatters.org\/education\/higher-education\/college-beat-higher-education\/2023\/02\/remote-proctoring-california-colleges\/\">why are professors at some Cal State campuses<\/a> and UC Berkeley still using software from a company at the center of that case? But water storage is a key part of that equation.<\/p>\n\n\n\n<p>Enter the long-awaited Sites Reservoir? In less than two weeks of storms, the reservoir could have captured 120,000 acre-feet of water from the Sacramento River, enough to serve about 1.3 million Californians for a year, <a href=\"https:\/\/sitesproject.org\/wp-content\/uploads\/2023\/01\/Sites-Reservoir-Press-Release_Storm-Diversion-Data_1.18.2023.pdf\">according to water agencies supporting the project<\/a>. When complete, Sites would store 1.5 million acre-feet, compared to 50 million total for California\u2019s existing reservoirs.<\/p>\n\n\n\n<p>But the $4.4 billion project has been on the drawing board for more than 40 years, prompting a growing chorus of criticism from legislators and growers. So <a href=\"https:\/\/calmatters.org\/environment\/2023\/02\/california-sites-reservoir\/\">what\u2019s the holdup?<\/a>&nbsp;<\/p>\n\n\n\n<p>CalMatters&#039; <a href=\"https:\/\/calmatters.org\/author\/alastair-bland\/\">\u963f\u62c9\u65af\u6cf0\u5c14\u00b7\u5e03\u5170\u5fb7<\/a> explains: Acquisition of water rights, permitting and environmental review are still in the works. Photo by Brian Frank for CalMatters<\/figcaption><\/figure>\n\n\n\n<p>In the latest effort to help low-income working families, Assemblymember <a href=\"https:\/\/calmatters.org\/legislator-tracker\/miguel-santiago-1973\/\">Miguel Santiago<\/a>, a Democrat from Los Angeles, has <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB1128\">introduced a bill<\/a> to expand the Young Child Tax Credit to at least one million more children. Santiago and a coalition of advocacy groups plan to announce the bill at a press conference in Los Angeles today.&nbsp;<\/p>\n\n\n\n<p>Currently, the state provides a $1,083 tax credit or refund to a family with a child younger than 6. <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB1128\">Assembly Bill 1128<\/a> would expand eligibility to families with children 6 to 17, 18- to 24-year-old students, and children of any age with permanent and total disabilities.&nbsp;<\/p>\n\n\n\n<p>The bill\u2019s sponsors say expanding the credit would help low-income families struggling with the high costs of groceries, rent and utility bills.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>TaShon Thomas<\/strong>, public policy director with United Way Bay Area, a part of the coalition: \u201cCalifornia has been leading the way and providing an example to other states and the federal government on creating ways to address and reduce childhood poverty.\u201d<\/li>\n<\/ul>\n\n\n\n<p>The bill could help offset the end of expanded <a href=\"https:\/\/apnews.com\/article\/child-tax-credits-program-ends-5ded3907c72ee0c3ad8a067a29d6b2c0\">federal child tax credits<\/a>, part of President Biden\u2019s $1.9 trillion coronavirus relief package, that <a href=\"https:\/\/calmatters.org\/california-divide\/2022\/11\/child-tax-credit\/\">slashed child poverty during the pandemic<\/a>.&nbsp;<\/p>\n\n\n\n<p>Advocates estimate that the legislation would cost an additional $700 million a year. But any proposed expansion to the state\u2019 safety net programs may be a hard sell <a href=\"https:\/\/calmatters.org\/california-divide\/2022\/12\/california-budget-deficit-safety-net\/\">given this year\u2019s state budget deficit<\/a>, as <a href=\"https:\/\/calmatters.org\/author\/alejandro-lazo\/\">\u4e9a\u5386\u676d\u5fb7\u7f57\u00b7\u62c9\u4f50<\/a> \u548c <a href=\"https:\/\/calmatters.org\/author\/jeanne-kuang\/\">\u909d\u5a67<\/a> of the CalMatters California Divide team have reported.&nbsp;<\/p>\n\n\n\n<p>In a separate effort to expand the state\u2019s Earned Income Tax Credit, Assemblymember <a href=\"https:\/\/calmatters.org\/legislator-tracker\/mike-gipson-1966\/\">Mike Gipson<\/a>, a Democrat from Gardena, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB1498\">introduced a bill<\/a> that would increase the minimum credit to at least $300. That would help the 62% of recipients who don\u2019t qualify for the Young Child Tax Credit, and about 2.5 million workers who don\u2019t have dependents, according to United Way Bay Area.&nbsp;<\/p>\n\n\n        <div class=\"cm-whatmatters-divider-plus\"><div class=\"cm-whatmatters-divider-plus__divider\"><\/div><\/div>\n        \n\n\n<p><strong>Another bill to watch: <\/strong><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB223\">Assembly Bill 223<\/a>, introduced by San Diego-area Democrat <a href=\"https:\/\/calmatters.org\/legislator-tracker\/christopher-ward-1976\/\">Christopher Ward<\/a>, would allow transgender people to seal records of their name-change requests.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Advocates for the effort note that transgender people can be susceptible to cyberbullying or even physical violence because their previous names <a href=\"https:\/\/apnews.com\/article\/district-of-columbia-washington-california-health-gender-c1c8a24a01c5d307bdc2e9037c1b0fd0\">are public record<\/a>.
