A 2024 ballot measure that would ban forced labor could alter those decisions.<\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\n\t\t\n<p><em>\u8fd9\u4e2a\u6545\u4e8b <a href=\"https:\/\/calmatters.org\/calmatters-en-espanol\/2024\/07\/californianos-votan-prohibir-esclavitud-noviembre-aumento-sueldo-prisioneros\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u4e2d\u6587<\/a><\/em><\/p>\n\n\n\n<p>Californians in the November election will vote on a ballot measure that would change the state Constitution to <a href=\"https:\/\/calmatters.org\/politics\/2024\/06\/anti-slavery-amendment\/\">ban the practice of forced labor<\/a> in jails and prisons, a proposal advocates say would wipe out a legacy of enslavement that dates to the 19th century.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/calmatters.org\/explainers\/california-ballot-measures-2024\/\" target=\"_blank\" rel=\"noreferrer noopener\">If Proposition 6 passes<\/a>, correctional officers could not order an inmate to work. What\u2019s less clear is what might happen if an inmate wants to work in one of the thousands of prison jobs that allow them to earn small amounts of money or to build skills.&nbsp;<\/p>\n\n\n\n<p>No one can say with certainty, but it raises the possibility that inmates could be paid <a href=\"https:\/\/calmatters.org\/tag\/minimum-wage\/\" target=\"_blank\" rel=\"noreferrer noopener\">minimum wage<\/a> for work they perform while incarcerated.<\/p>\n\n\n\n<p>The legal precedent that allows California prisons to pay sub-minimum wage to inmates \u2014 less than 74 cents an hour for most \u2014 draws in part from the provision in the state Constitution that would be overturned if voters pass the anti-slavery amendment.<\/p>\n\n\n\n<p>Deleting the provision that bans slavery except as punishment for a crime could open the door to higher pay for inmate labor depending on how courts interpret the ballot measure, according to experts and an analysis by the <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202320240ab628?slug=CA_202320240AB628\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Appropriations Committee<\/a>.<\/p>\n\n\n\n<p>&#8220;The long-settled legal doctrine here depends on constitutional permission for forced labor as punishment for crime,\u201d said David A. Carrillo, executive director of Berkeley Law&#8217;s California Constitution Center, in an email to CalMatters. \u201cRemoving that support raises difficult questions that courts will need to rethink \u2014 without an established foundation to build on.&#8221;<\/p>\n\n\n\n<p>Those questions derailed a similar proposal two years ago, when the state Finance Department estimated that <a href=\"https:\/\/apnews.com\/article\/prisons-california-gavin-newsom-minimum-wage-slavery-a0aed840fc6dc54c7eb0da98d0f6bb05\" target=\"_blank\" rel=\"noreferrer noopener\">paying minimum wage to inmates<\/a> would cost taxpayers $1.5 billion a year. California\u2019s entire corrections budget is expected to cost $18 billion this fiscal year.<\/p>\n\n\n\n<p>This time, Gov. Gavin Newsom signed a separate law that will take effect if voters pass the ballot measure and would empower prisons to create <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202320240ab628\" target=\"_blank\" rel=\"noreferrer noopener\">voluntary work programs<\/a>. The law does not detail a new pay scale. Only time will tell if local governments and the prison system set wages that preserve the current network of jobs for inmates.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Money \u2014 for inmate workers or in increased costs to taxpayers \u2014 &nbsp;is not the primary consideration for the advocates who want to ban forced labor in prisons.<\/p>\n\n\n\n<p>The proposal is one of <a href=\"https:\/\/blackcaucus.legislature.ca.gov\/news\/california-legislative-black-caucus-introduces-2024-reparations-legislative-package\" target=\"_blank\" rel=\"noreferrer noopener\">one of 14 bills the California Legislative Black Caucus<\/a> prioritized this year from a state-funded reparations task force in 2023.<\/p>\n\n\n\n<p>California was <a href=\"https:\/\/apnews.com\/article\/2022-midterm-elections-slavery-on-ballot-561268e344f17d8562939cde301d2cbf\" target=\"_blank\" rel=\"noreferrer noopener\">not a slave state<\/a>, but its Constitution has allowed since its inception for involuntary work as a form of legal punishment. Several other states, including Colorado and Alabama, have also recently adopted measures banning <a href=\"https:\/\/apnews.com\/article\/2022-midterm-elections-slavery-on-ballot-561268e344f17d8562939cde301d2cbf\">involuntary servitude<\/a> in the past few years.<\/p>\n\n\n\n<p>\u201cThe idea that we would have to pay individuals should have never been any reason for us to not end slavery, because we should not be interested in exploiting human labor,\u201d Carmen-Nicole Cox, director of government affairs with ACLU California Action, previously told CalMatters.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-increased-pay-for-inmate-workers-in-2-states\">Increased pay for inmate workers in 2 states<\/h3>\n\n\n\n<p>California\u2019s prison system employs just under 40,000 workers across various industries, including firefighters, technicians, custodians, construction workers, food service workers and hospice care staff. A union dispute could end them<\/a><\/h3>\t\t\t\t\t\t\t\t\t\t<div class=\"entry-meta\">\n\t\t\t\t\t<time class=\"entry-date published\" datetime=\"2024-06-25T05:30:00-07:00\" data-no-translation=\"\">6 \u6708 25, 2024<\/time><time class=\"updated\" datetime=\"2024-06-25T22:31:19-07:00\">2024\u5e746\u670825\u65e5<\/time>\t\t\t\t<\/div><!-- .entry-meta -->\n\t\t\t\t\t\t\t\t<\/div><!-- .entry-wrapper -->\n\t<\/article>\n\n\t\t\t\t<\/div>\n\t\t\n\t<\/div>\n\t\n\n\n<p>Other states also <a href=\"https:\/\/onlinedegrees.kent.edu\/blog\/how-much-do-prisoners-make-in-each-state\">pay<\/a> <a href=\"https:\/\/onlinedegrees.kent.edu\/blog\/how-much-do-prisoners-make-in-each-state\">far below<\/a> their state\u2019s minimum wage for non-incarcerated employees, though there are notable exceptions.&nbsp;<\/p>\n\n\n\n<p>The U.S. 4th Circuit Court of Appeals <a href=\"https:\/\/www.aclu-md.org\/en\/press-releases\/aclu-celebrates-win-right-fair-wages-workers-who-are-incarcerated-case-challenges\" target=\"_blank\" rel=\"noreferrer noopener\">ruled in May<\/a> that Maryland workers at a recycling plant outside of prison walls could be eligible to receive minimum wage under federal law. Legislation in Colorado gave <a href=\"https:\/\/www.denverpost.com\/2022\/03\/30\/colorado-prison-labor-minimum-wage\/#:~:text=UPDATED%3A%20March%2031%2C%202022%20at,laborers%20mere%20cents%20per%20day.\" target=\"_blank\" rel=\"noreferrer noopener\">minimum wage to a portion<\/a> of inmate workers in an off-site program in 2022, but other states have seen failed legislative efforts surrounding <a href=\"https:\/\/stateline.org\/2022\/09\/07\/advocates-seek-to-make-prison-work-voluntary\/\" target=\"_blank\" rel=\"noreferrer noopener\">minimum wages for inmates<\/a>.<\/p>\n\n\n\n<p>California courts have consistently upheld pay below the minimum wage for prison inmates. Most recently, the California Supreme Court in April <a href=\"https:\/\/www.aclu.org\/press-releases\/aclu-responds-to-california-supreme-court-ruling-on-minimum-wage-for-incarcerated-workers\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed claims from inmates<\/a> at Alameda County\u2019s Santa Rita Jail who wanted minimum wage for their work with a food services contractor. The justices found the inmates were not entitled to pay.&nbsp;<\/p>\n\n\n\n<p>But if the new anti-slavery measure passes, federal employment laws, including those on wages and benefits, might begin to cover inmates who are required to work, Carrillo said.<\/p>\n\n\n\n<p>Carrillo said inmates in certain circumstances could challenge their pay under a voluntary work program, potentially by claiming they were coerced to earn benefits. Another scenario could be that they claim the compensation they receive is not sufficient to make the work actually voluntary.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-cost-of-minimum-wage-for-inmate-workers\">Cost of minimum wage for inmate workers<\/h3>\n\n\n\n<p>Such concerns have previously loomed over anti-slavery discussions in the Legislature. Sen. Steve Glazer, a Democrat from Orinda, opposed the previous proposal to prohibit forced labor. Aside from the cost, he warned that it could decrease restitution for victims if inmates refuse to work, \u201cundermine our rehabilitation programs\u201d and \u201cmake prisons more difficult to manage safely\u201d&nbsp;<\/p>\n\n\n\n<p>\u201dInmates will sue the state claiming their wages are too low, their hours are too high, or that it is unconstitutional to tie good time credits and early release to their willingness to work,\u201d Glazer said in a <a href=\"https:\/\/sd07.senate.ca.gov\/index.php\/press-release\/statement-aca-3\" target=\"_blank\" rel=\"noreferrer noopener\">written statement<\/a> from 2022.&nbsp;<\/p>\n\n\n\n<p>He voted for the bill and its companion legislation this time around. A spokesperson for Glazer declined to comment further.&nbsp;<\/p>\n\n\n\n<p>The new measure does not contain language Glazer asked for back in 2022, such as an exemption for food service workers and groundskeeping staff from the definition of involuntary servitude.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-never-about-wages\">&#8216;Never about wages&#8217;<\/h3>\n\n\n\n<p>Activists who fought to revive the measure are hopeful that voters will pass it. They see the voluntary work clause as a concession that will allow them to keep the conversation focused on the conditions incarcerated workers are facing.<\/p>\n\n\n\n<p>\u201cWe&#8217;re not saying that it&#8217;s right what the wages are, whatsoever, but that\u2019s a whole different issue,\u201d said <a href=\"https:\/\/calmatters.org\/projects\/california-parolees-voting-rights-nunez-aca6\/\">Esteban Nu\u00f1ez<\/a>, a chief strategy consultant and lobbyist for the Anti-Recidivism Coalition, who has pushed for higher wages for inmates in the past. \u201cThis was never about wages, it was about just literally giving somebody the agency to tailor their own rehabilitative programming journey.\u201d<\/p>\n\n\n\n<p>He cited a case in 2022 where a Colorado judge ruled that, despite the state\u2019s anti-slavery amendment, incarcerated workers <a href=\"https:\/\/www.cpr.org\/2022\/02\/15\/prisoners-allege-forced-labor-violates-states-anti-slavery-law\/#:~:text=The%20suit%20was%20dismissed%20and%20they%20didn%E2%80%99t%20appeal.\">did not qualify<\/a> for minimum wage.
